Call Voyager Terms and Acceptable Use Policy
By using the callvoyager.com,
agentvoyager.com, 911meeting.com, broadcastvoyager.com, recordmyconversation.com,
remindme.com, conferencevoyager.com, emailcruiser.com, pbxvoyager.com or worldclasssoftware.com
web sites as well as their associated voice portals (the "Services"), all of
which are services of World Class Software, d/b/a Call Voyager
( Call Voyager ), you are agreeing to be bound by the following terms
and conditions and acceptable use policy (collectively the Terms ).
World Class
Software reserves the right to update and change the Terms from time to time
without notice. Any new features that
augment or enhance the current Services, shall be subject to the Terms. Continued use of the Service after any such
changes shall constitute your consent to such changes. You can review the most
current version of the Terms at any time at: http://www.callvoyager.com/terms.html
Violation of
any of the terms below will result in the termination of your Account. You
agree to use the Service at your own risk.
Account Terms
- You must be 16 years or
older to use this Service.
- You must be a human.
Accounts registered by bots or other automated methods are not permitted.
- You must provide your legal
full name, a valid email address, and any other information requested in
order to complete the signup process.
- Your login may only be used
by one person. A single login shared by multiple people is not permitted.
You may create new accounts with separate logins for as many people as
you'd like.
- You are responsible for
maintaining the security of your account and password. World Class
Software cannot and will not be liable for any loss or damage from your
failure to comply with this security obligation.
- You are responsible for all
activity that occurs under your account.
- You may not use the Service
for any illegal or unauthorized purpose. You must not, in the use of the
Service, violate any laws or regulations in your jurisdiction (including
but not limited to privacy laws and local, state and federal
telecommunications regulations).
- Warning - you should check on the legality of recording someone
without their permission. Thirty-eight states require only one party to
know the call is being recorded. It is your obligation to understand the details
and comply with the law. This is your responsibility, not ours!
Payment, Refunds, Upgrading and Downgrading Terms
- A valid credit card is
required for paid accounts. Free accounts are not required to provide a
credit card number.
- Once
your account is set up and you have paid your set up fee and first month
of service, you will be billed monthly starting on the same day of the
month that your account was initially created (e.g. if your service starts
on the 17th of the month, you will be billed on the 17th
each month
- If you
start on the 31st of the month, you will be billed on the last
day of each subsequent month
- If you
cancel prior to the processing of your monthly invoices, you will not be
charged.
- The
Service is billed in advance on a monthly basis for your base minutes
and retroactively for any overages (e.g. if you use over 1000 minutes on
the Enhanced package, your next credit card charge will be for $99.95
for the upcoming month PLUS your overage (@$0.099), from the previous
month.
- Call
Voyager service is non-refundable. There will be no refunds or credits for
partial months of service, upgrade/downgrade refunds, or refunds for
months unused with a pre-paid account. In order to treat everyone equally,
no exceptions will be made.
- All fees are exclusive of
all taxes, levies, or duties imposed by taxing authorities, and you shall
be responsible for payment of all such taxes, levies, or duties, excluding
only United States (federal or state) taxes.
- You may upgrade or
downgrade your Service plan at any time. For any upgrade or downgrade in plan level, your credit card that
you provided will automatically be charged the new rate on your next
billing cycle. However, you will
be charged any overages in the current month
- Downgrading your Service
may cause the loss of call detail records, features, or capacity of your
Account. Call Voyager does not accept any liability for such loss.
Cancellation and Termination
- If you are not satisfied with the Call Voyager services, or any
services, content, or other information on the Call Voyager website and
voice portal, you may stop using the voice + web services at any time and
you have no further obligation.
- You are
solely responsible for properly cancelling your account.
- To cancel your account, you
must send an email to support@callvoyager.com
you will receive an email confirmation of your cancellation.
- All of your account set up
files, configuration and call detail records will be immediately deleted
from the Service upon cancellation. This information can not be recovered
once your account is cancelled.
- If you cancel the Service
before the end of your current paid up month, your cancellation will take
effect immediately and you will not be charged again.
- Call Voyager, in its sole
discretion, has the right to suspend or terminate your account and refuse
any and all current or future use of the Service, or any other World Class
Software service, for any reason at any time. Such termination of the
Service will result in the deactivation or deletion of your Account or
your access to your Account, and the forfeiture and relinquishment of all records
in your Account. Call Voyager reserves
the right to refuse service to anyone for any reason at any time.
Modifications to the Service and Prices
- World Class Software
reserves the right at any time and from time to time to modify or
discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
- Prices of all Services,
including but not limited to monthly subscription plan fees to the
Service, are subject to change upon 30 days notice from us. Such notice
may be provided at any time by posting the changes to the Call Voyager
Site (www.callvoyager.com) or the Service itself.
- World Class Software shall
not be liable to you or to any third party for any modification, price
change, suspension or discontinuance of the Service.
Interruptions to the Call Voyager
Website
- You understand that Call Voyager has no control
over the third party networks that you access in order to use the Call
Voyager Website, and that interruptions of the Call Voyager Website may
occur due to disruption of other network transmissions, completely beyond
our control.
Privacy Policy
The information we obtain
through your use of the Call Voyager Services is subject to our PRIVACY POLICY,
which is specifically incorporated by reference into these TERMS. Please review our PRIVACY POLICY. Changes to the PRIVACY POLICY will be
effective immediately upon notice thereof, which will be given by means of a
written announcement on the home page and/or member sign-in page on the Call
Voyager Website.
Intellectual Property Information
- The material and content including, but not
limited to, text, graphics, logos, button icons, images, audio clips, data
compilations, and software, and the compilation thereof, accessible from
the Call Voyager Website and/or Voice Portal and any other website owned
and operated by CALL VOYAGER, is the property of Call Voyager or the party
that provided or licensed any part of the Content to CALL VOYAGER. As
such, the Content may not be copied, distributed, republished, uploaded,
posted, or transmitted in any way without the prior written consent of
CALL VOYAGER.
- The trademarks, logos, and service marks
displayed on the Call Voyager Website, are the registered and unregistered
marks of CALL VOYAGER, or our partners, in the United States and other
countries, and are protected by United States and international trademark
laws.
Indemnification
You will indemnify and hold
CALL VOYAGER, its service providers, employees, agents, officers, directors,
and contractors (the "Indemnified Parties") harmless from any breach
of the TERMS by you, including any use of the Services other than as expressly
authorized in the TERMS. You also agree to indemnify us for any loss, damages,
or costs, including reasonable attorneys' fees, resulting from your use of
software robots, spiders, crawlers, or similar data gathering and extraction
tools, or any other action you take that imposes an unreasonable burden or load
on our infrastructure. You agree that the Indemnified Parties will have no
liability in connection with any such breach or unauthorized use, and you agree
to indemnify any and all resulting loss, damages, judgments, awards, costs,
expenses, and attorneys' fees of the Indemnified Parties in connection
therewith. You will also indemnify and hold the Indemnified Parties harmless from
and against any claims brought by third parties arising out of your use of the
information accessed from the Call Voyager Website and/or the Voice + Web
services.
General Conditions
- Your use of the Service is
at your sole risk. The service is provided on an as is and as
available basis.
- Technical support is only
provided to paying account holders and is only available via email.
- You understand that Call
Voyager uses third party vendors and hosting partners to provide the
necessary hardware, software, networking, storage, and related technology
required to run the Service.
- You agree not to reproduce,
duplicate, copy, sell, resell or exploit any portion of the Service, use
of the Service, or access to the Service without the express written
permission by Call Voyager.
- Verbal, physical, written
or other abuse (including threats of abuse or retribution) of any World
Class Software customer, employee, member, or officer will result in
immediate account termination.
- You understand that the
technical processing and transmission of the Service, including your
Content, may be transferred unencrypted and involve (a) transmissions over
various networks; and (b) changes to conform and adapt to technical
requirements of connecting networks or devices.
- You must not transmit any
worms or viruses or any code of a destructive nature.
- If your usage significantly
exceeds your allowable minutes per month, or significantly exceeds the
average bandwidth usage (as determined solely by Call Voyager) of other Call
Voyager customers, we reserve the right to immediately disable your
account or throttle your usage until you have consented to an additional
payment on your credit card.
- World Class Software does
not warrant that (i) the service will meet your specific requirements,
(ii) the service will be uninterrupted, timely, secure, or error-free,
(iii) the results that may be obtained from the use of the service will be
accurate or reliable, (iv) the quality of any products, services,
information, or other material purchased or obtained by you through the
service will meet your expectations, and (v) any errors in the Service
will be corrected.
- You expressly understand
and agree that World Class Software shall not be liable for any direct,
indirect, incidental, special, consequential or exemplary damages,
including but not limited to, damages for loss of profits, goodwill, use,
data or other intangible losses (even if World Class Software has been
advised of the possibility of such damages), resulting from: (i) the use
or the inability to use the service; (ii) the cost of procurement of
substitute goods and services resulting from any goods, data, information
or services purchased or obtained or messages received or transactions
entered into through or from the service; (iii) unauthorized access to or
alteration of your transmissions or data; (iv) statements or conduct of
any third party on the service; (v) or any other matter relating to the
service.
- The failure of World Class
Software to exercise or enforce any right or provision of the Terms shall
not constitute a waiver of such right or provision. The Terms constitutes
the entire agreement between you and World Class Software and govern your
use of the Service, superceding any prior agreements between you and World
Class Software (including, but not limited to, any prior versions of the Terms).
